⚠ Late-Breaking — April 11 (Apple Vision OCR)

Two case-changing discoveries landed today.

A methodology upgrade from Tesseract to Apple Vision OCR surfaced two findings latent in the evidence corpus. Both are now logged as CLAUDE.md Findings #105 and #106. Together they collapse Goldberg's two strongest remaining defenses — on Freedom Bank spoliation and on the July 18 email “elimination.”

Litman = Chairman of Freedom Bank Executive Loan Committee

The internal Freedom Bank of Virginia Director Committees roster (8/20/2013), surfaced by Apple Vision OCR, names Richard C. Litman, Chairman of the Executive Loan Committee (“Meets Weekly”) plus Strategic Planning and Corporate Governance memberships. Goldberg closed a trust account at the very bank Litman formerly governed. Confirms the nathlaw.com bio line “chairman of the board of a local bank” — which NGM is still publishing.

Finding #106 · Email Fraud

8,024+ emails to the “eliminated” mailboxes

Goldberg told Litman the accounts were eliminated on 7/18/2025. Header sweep proves 7,519 emails landed in litman@4patent.com post-7/21 (through 12/31/2025), 334 in r.litman@4patent.com, and 171 in rlitman@nathlaw.com. Microsoft 365 quarantine notices prove the mailboxes were live. Goldberg eliminated ACCESS, not the mailbox — meaning he could monitor.

Spoliation Track

Freedom Bank — Undisclosed Third Trust

NGM operated five bank accounts; only two appear in its own Exhibit A. A Virginia trust account was closed by transfer seven days after the lawsuits were filed — seventeen months after Litman demanded closure in writing. With Finding #105, the bank in question is the bank Litman formerly governed.

The Wire

“Close Account” Memo

One day after suit, a $24,495.15 wire from Freedom Bank account ending 028 to Bank of America NYC — with a memo that literally reads “NGM Bank to Bank transfer Close Account.” Six Bates-stamped copies in hand — all routed to the supposedly “eliminated” litman@4patent.com.

The Cutoff

Fidelity Payment Cutoff

Fourteen consecutive monthly payments through May 21, 2025. Zero payments June, July, August, or September — the exact month litigation was threatened. Then one unexplained $135,947.69 wire on October 8.
