Pattern: USPTO sends trademark correspondence to Litman as attorney of record. Kline handles dozens of emails on the same matter. Litman's name stays on the filing. This is the same pattern as the patent prosecution: Litman's name on the official record, someone else doing the work.


3. The July 2, 2025 Section 8 Filing -- NIC-O-BOLI Confirmed

Registration 5,804,556 = THE ORIGINAL NIC-O-BOLI (Nicola Pizza, docket 6217.50)

On July 2, 2025, the USPTO sent a filing receipt directly and solely to rlitman@nathlaw.com:

Subject: "6217.50 Registration Number 5804556: Received Your Combined Declaration of Use and Incontestability Under Sections 8 and 15"

This is significant for three reasons:

  1. Sent ONLY to Litman -- no Kline, no docketing department, no efile. The USPTO treated Litman as the sole attorney of record for this registration.
  2. Combined Sections 8 and 15 filing -- a Section 8 declaration requires someone to sign under penalty of perjury that the mark is in use. A Section 15 filing claims incontestability. Someone at NGM filed this in Litman's name on July 2, 2025 -- after the lawsuit was filed (case index date 2025).
  3. Nicola Pizza -- this is the same client whose trust ledger shows all billing under "RL" (Richard Litman), whose outside counsel (Ciro Poppiti) contacted Litman by name, and who has 30 total USPTO emails across 10 docket numbers.
