Read this first — five framing rules

Before any search, before any document mark — these five rules govern how every exhibit gets framed. They've been tested against a year of prior work and protect against framing errors that have already cost the case time on this record:

  1. Identity, not accounting. Every claim is commercial exploitation of name/identity under NY Civil Rights Law §§ 50-51. Not breach. Not accounting fraud. Frame every exhibit as a publication / use of name.
  2. Publication, not signature. The harm is Goldberg-caused publication of Plaintiff's name on the patent face / INID (74) field. Signature questions are downstream willfulness.
  3. Volume, not dollars. Lead with the day-by-day pattern of identity uses to clients. Drumbeat proves systematic exploitation. Dollars are the consequence.
  4. Royalty, not commission. The 20% is a royalty — the arbitrator's exact words: "payment for the privilege of servicing the lucrative client base." Never call it a commission.
  5. Deferred payment, not back pay. Unpaid 20% is deferred payment for the Practice. Not back-pay. Not wages. That framing is wrong, repeatedly.

Three Elements of § 50-51 you're proving

Decision-marking pass — first-cut logic

Use the dropdown in each row's detail pane (or the right-click menu, or keyboard shortcuts: P / R / W / N / H / V).

Mark Produce (P): Anything in binders 1–9 above (face-page patents, USPTO-to-both, Martha Long client emails, Goldberg personal acts, spoliation events, consent rebuttal, damages anchor, TM track). All ~5,300 post-SOL acts are responsive — produce them all. The volume is the case.

Mark Produce w/ Redactions (R): Any row that contains a third-party PII (SSN, account number, etc.) but is otherwise responsive. Use the Redaction Notes field to spell out what to redact.

Mark Withhold-Privileged (W): Communications between Plaintiff and Scott Woller (attorney-client, CPLR 4503); communications labeled "settlement" or covered by CPLR 4547; spousal communications (CPLR 4502(b)); your own work product (CPLR 3101(c)). Pick a Privilege Basis from the dropdown so the privilege log auto-populates.

Mark Withhold-Non-Responsive (N): Personal emails not bearing on case theory (LinkedIn notifications, news subscriptions, etc.). The corpus has thousands of these — bulk-mark via filter (e.g., from = linkedin.com, then "Bulk... Withhold-Non-Responsive").

Mark Hold (H): Any item where you want a second-pass before deciding. Date-restricted items (post-suit communications) go here pending privilege analysis.

Mark Needs 2nd Review (V): Items that need Plaintiff's input — e.g., "is this a settlement communication or a regular business email?" Plaintiff can sort the V-flagged items in his next session.


What the right detail pane shows for each row (now with attachment-content)

When you click any row:

  1. Metadata — From, To, CC, Subject, Date, Attachments, Tags, Source, Native file path
  2. Body Preview — first 800 chars of email body (the Concordance ceiling for emails; full body for documents)
  3. Extracted Contentnew as of 4/29/2026 — the OCR'd / extracted text from the underlying PDF/image/document. The search hit is highlighted in context (±100 chars). For documents this is the full extracted content (3,130 docs covered via Apple Vision).

If you have two hours today, run this exact sequence:

The case's tightest single-day three-channel chain (Ex A-12 / Ex B-4 / Ex B-12) populated.
0:35 – 0:55 Run searches #2, #3, #11, #12 (responsible RL, Correspondence Address: Richard C. Litman, expired RL, 694,478.67). Add hits to "Goldberg personal acts" or "Damages anchor". Internal-attribution and damages backbones populated.

After 2 hours you'll have ~50-100 hot docs, 10 populated binders, and a JSON backup. That's the foundation.
