Line 74 Control Inference — Goldberg Had Control Over Attorney Designation

Purpose: Document the logical inference that if Goldberg's name appears on Line 74 of a patent, he had control over whose name was listed as attorney — and therefore could have controlled when Litman's name was used.

Case: Litman v. Goldberg, Index No. 524343/2025 (NY Sup. Ct., Kings County)


The Inference

If Joshua Goldberg's name appears on Line 74 (Attorney, Agent, or Firm) of a patent, that implies he had control over whose name was designated as attorney on that patent.

Why This Matters

  1. Line 74 is a choice. The attorney block on a patent front page is set by the correspondence address and practitioner information submitted during prosecution. Someone must decide and submit that information.

  2. Control over his own name. If Goldberg's name appears on Line 74, he (or someone acting under his direction) had to submit or approve that designation. That demonstrates he had the ability to control what went on Line 74.

  3. Same control for Litman's name. If he could control whose name went on Line 74 when his own name appeared, he had the same control when Litman's name appeared. This supports the argument that he directed or permitted the use of Litman's name on other filings (assignments, correspondence, etc.).

  4. Willfulness. That control makes it harder to argue that Litman's name appeared without Goldberg's knowledge or involvement.

US 11,858,934 B1 — King Faisal University; issued 2024-01-02; Joshua Goldberg on Line 74 (per USPTO attorney search). This is the earliest confirmed KFU patent with Goldberg on Line 74.

It is a concrete example of this inference: Goldberg had the ability to get his name onto Line 74 by January 2, 2024, which demonstrates control over the attorney designation. The same control would have applied when Litman's name was used.
