Prepared: April 13, 2026 Purpose: Pair IFW prosecution records with eGrant PDFs to establish cross-system chains proving Richard C. Litman's name was used as the named correspondence attorney on USPTO records throughout the post-SOL period, and that this name was unilaterally removed by Goldberg on May 1, 2025.
Plaintiff attaches true and correct copies of USPTO Image File Wrapper (IFW) Filing Receipts and corresponding eGrant PDFs for five exemplar patents, plus two USPTO notifications documenting the unilateral removal of Plaintiff's name from Customer Number 37833. Each Filing Receipt was generated by the USPTO and mailed to the correspondence address on record -- in every case listing "Richard C. Litman" as the named attorney above "Nath, Goldberg & Meyer." The IFW filing/status dates align with the eGrant issue dates, and SHA-256 digests authenticate the PDF artifacts. The two CN-37833 notifications (Exs. A-6a and A-6b) establish that on May 1, 2025, Defendant Goldberg unilaterally removed Plaintiff's name from this correspondence record while retaining Plaintiff's registration number on the practitioner roster. See Exs. A-1 through A-6b.

This is the December 21, 2023 bombshell -- Goldberg signed both the Power of Attorney and the KFU assignment cover sheet on the same day. This is the causal chain in a single exhibit: Goldberg personally files the POA designating CN-37833 (which carries Litman's name as correspondence attorney), the USPTO generates a Filing Receipt addressed to "Richard C. Litman," and the patent issues with Litman on Line 74 of the grant. All three documents -- POA, Filing Receipt, and eGrant -- are in evidence. Filed six months after the arbitration decision (6/14/2023), this patent proves Goldberg was not merely inheriting legacy filings but was actively and personally creating new prosecution records bearing Litman's name.

This is the clean, routine exemplar. The POA was filed 15 days after the arbitration decision (6/14/2023). Every IFW step ran exactly as designed: Goldberg signed the POA, the USPTO generated a Filing Receipt addressed to "Richard C. Litman," the patent prosecuted to allowance, and the grant issued with Litman on Line 74. This patent demonstrates the system running on autopilot -- Goldberg files, Litman's name propagates through every outgoing document, and money flows through the NGM trust infrastructure. There is no intervening authorization from Litman at any stage of this chain.

The USPTO Filing Receipt, mailed December 16, 2021, bears the following correspondence block:
37833 Richard C. Litman Nath, Goldberg & Meyer 112 S. West Street Alexandria, VA 22314
Patent Grant XML explicitly names Litman as agent: <agent><orgname>Nath, Goldberg & Meyer</orgname></agent> and <agent><first-name>Richard C.</first-name><last-name>Litman</last-name></agent>. This is the one exhibit where Litman's name appears verbatim in the XML agent tags of the official patent grant record.

This is the keystone exhibit. Litman's name appears explicitly in the Patent Grant XML -- not merely inferred from CN-37833, but printed as the named agent on the official patent record. The non-KFU client (UAEU/Al Ain Distribution Company) diversifies the evidence beyond the Gulf university portfolio, demonstrating that the name-use pattern extended across NGM's entire institutional client base. The assignment correspondent address at "112 S. West Street, Nath, Goldberg & Meyer" further ties the firm to the CN-37833 prosecution chain. Filed and granted entirely within the post-SOL period (November 2021 through August 2022), 14 months after the June 15, 2020 cutoff.

This is THE LAST LITMAN PATENT. Granted January 14, 2025. One week later, on January 21, 2025, Patent 12,201,650 was granted with Goldberg -- not Litman -- on Line 74 for the first time. Every one of the 205 NGM patents granted after January 14, 2025 lists Goldberg on Line 74. The Filing Receipt (April 2, 2024) still shows "Richard C. Litman" in the correspondence block. The switchover happened in the eGrant system -- not in the correspondence record. Litman's name persisted on the CN-37833 Filing Receipts until Goldberg removed it on May 1, 2025 (see Exhibit A-6b). The complex prosecution history -- allowance, abandonment for non-payment, petition to revive, reinstatement -- shows NGM actively fighting to get this patent granted even as Goldberg was simultaneously erasing Litman's name from other systems.

This exhibit serves as a control/contrast. It shows what the IFW looks like when a different firm and customer number handle a patent for a comparable Saudi institutional client. Customer Number 23557 (Saliwanchik) replaces CN-37833 (NGM) on all IFW rows. The clean pivot between customer numbers is visible in the prosecution record. This preempts any chain-of-custody attack: when a different firm handles the matter, the customer number changes and Litman's name disappears. When CN-37833 appears, it is definitively Nath, Goldberg & Meyer -- and by extension, the prosecution infrastructure that carried Litman's name without his authorization.
Suggested Caption: "Ex. A-5: IFW Filing Receipt for App 18/181,890 (CN=23557, Saliwanchik firm -- control exhibit showing CN pivot) paired with eGrant for Patent 12,295,955; SHA-256: 1804306b79a5873b..."
On May 1, 2025 at 12:43 PM, Goldberg changed the CN-37833 correspondence record from "Richard C. Litman / Nath, Goldberg & Meyer" to "Nath, Goldberg & Meyer" alone -- removing Litman's name entirely.
Two Bates-stamped documents from Defendant's own production bracket this event:
Exhibit A-6a (Bates: C2051472_ND0000058048): USPTO "Notice of Email Update for Customer Number -- 37833," dated July 17, 2024 at 3:10 PM. This notification was sent to litman@4patent.com, uspto_nva@nathlaw.com, and jgoldberg@nathlaw.com. At this point, the CN-37833 correspondence record still carried Richard C. Litman's name.
Exhibit A-6b (Bates: C2051472_ND0000069257): USPTO "Notice of Email Update for Customer Number -- 37833," dated May 1, 2025 at 12:43 PM. This notification was sent to jgoldberg@nathlaw.com, litman@4patent.com, and uspto_nva@nathlaw.com. The CN-37833 correspondence record no longer carried Litman's name.
The last daily notification listing Litman's name on CN-37833 was sent at 04:03:17 AM on May 1, 2025. The first daily notification without Litman's name was sent at 04:01:42 AM on May 2, 2025. The change was made by Goldberg in the 20-hour, 40-minute window between those two automated notifications.
No email authorization from Litman exists for this change. The modification was executed through USPTO's Patent Center self-service portal, which allows registered practitioners to update Customer Number correspondence details. Goldberg made two changes in the same session:
Critically, Litman's registration number (Reg. 30868) was not removed from the CN-37833 practitioner roster. He remained technically authorized to practice before the USPTO on matters routed through this customer number. Only his name was stripped from the correspondence record. This is the hallmark of a cosmetic erasure designed to stop Litman's name from printing on future Filing Receipts, Notices of Allowance, and other outgoing USPTO documents -- while preserving the legal fiction that Litman was still an authorized practitioner.
This name removal occurred:
This is consciousness of guilt. Goldberg was systematically erasing Litman's name from every system under his control, in sequence, over a six-month period.
The following sequence establishes a deliberate, system-by-system campaign to remove Litman's name from all professional records:
| # | Date | System | Action | Evidence |
|---|---|---|---|---|
| 1 | Jan 14-21, 2025 | Patent Front Pages (Line 74) | Litman removed; Goldberg substituted | Patent Grant XML comparison: 12,194,434 (Jan 14, Litman) vs. 12,201,650 (Jan 21, Goldberg) |
| 2 | May 1, 2025 | CN-37833 Correspondence | Litman's name removed from correspondence address | Ex. A-6a (before) vs. A-6b (after) |
| 3 | June 10, 2025 | nathlaw.com Website | Litman demands removal -- proving he was still listed | Text message record |
| 4 | ~June 25, 2025 | nathlaw.com Website | "Retired" added (but page stays up through Aug 23) | Google search results; Wayback Machine |
| 5 | July 18, 2025 | Email Accounts | litman@4patent.com and rlitman@nathlaw.com access cut off | Heba Carter termination letter; 8,024 post-elimination emails in discovery |
| 6 | Sept 5, 2025 | nathlaw.com Website | Litman removed entirely from website | Wayback Machine |
The sequence is telling: Goldberg controlled each system and acted on each in turn. The Line 74 switchover came first (a system only Goldberg could control through the IFEE form). The CN-37833 correspondence change came next (a system only a registered practitioner with Patent Center access could modify). The website and email changes followed as the litigation threat materialized.
The June 10 demand is particularly significant: Litman had to ask for his name to be removed from the website -- proving he did not consent to or authorize its continued presence. Goldberg complied partially (adding "Retired") but the page remained live for nearly three more months.
