# Middle-East Clients — § 51 Exhibit Binder Summary

**Case:** Litman v. Goldberg, Index No. 524343/2025 (N.Y. Sup. Ct., Kings County)
**Theory:** NY Civil Rights Law § 51 (misappropriation of name) — post-arbitration commercial-use record of the Litman identity in NGM client correspondence.

This memo rolls up the exhibit-binder treatment the client approved for KFU on 4/18/2026 across the remaining five Middle-East clients: KSU, UAEU, Kuwait U, SQU, and Qatar Foundation.

## Scope and window

- **Window:** 6/14/2023 (arbitration award) → 7/18/2025 (termination).
- **Sender filter:** `@nathlaw.com` or `@4patent.com`.
- **Recipient filter:** client-specific domain regex (see per-client memos).
- **USPTO-document filter:** attachment name or subject keyword hit, or docket-style filename pattern.

## Willfulness-anchor findings

Search methodology: for each client, scan the 276,899-row Concordance DAT for Goldberg-authored emails (FROM matches `goldberg|jbg@|jgoldberg`) sent to the client domain in the window, body/subject containing phrases naming Litman in the third person ("our attorney", "Mr. Litman", "Richard Litman", "attorney of record", "Litman's [questions|review|comments]", "our patent attorney", etc.). A broader V2 search accepting any NGM sender and weaker plural phrasings ("one of our attorneys") was run for clients where V1 found nothing.

Notes:
- SQU discovery tier was 268 (the full candidate pool — 500 not reached).
- QF only has 42 candidates total, so we produced a single full-pool binder rather than a 100 / 500 split.
- Kuwait U and QF binders do not include an ANCHOR exhibit. They open directly with Exhibit 1 (top-ranked § 51 use). The cover page explicitly notes "no willfulness anchor identified for this client".

## Gaps / follow-up

1. **Kuwait U willfulness anchor — dig deeper.** Body-text is only `BODY_PREVIEW` (truncated); inspect full native `.msg` / `.eml` files for Kuwait U in the post-arbitration window. Also check KFU pattern — was Kuwait U routed via a `kwu@4patent.com` alias the same way KFU was via `kfu@4patent.com`? The alias inventory confirms `kwu@4patent.com` exists (see `output/4PATENT_ALIAS_DEFINITIVE_COUNTS.csv`). Possible that Goldberg emails used that alias and were filtered out of the Goldberg-authored set because the FROM field did not match `goldberg` (e.g., if an alias was used in FROM). Worth a second pass that scans FROM fields for `kwu@4patent.com` authored by Goldberg's account.
2. **QF willfulness anchor — likely does not exist.** QF volume is 56 in-window emails; the client was a small matter-holder. The § 51 theory here rests on the USPTO-document commercial uses themselves, not on a witness-stand anchor. Consider dropping QF as a targeted "willfulness" exhibit vehicle and using it instead as a "volume even at smallest clients" example.
3. **SQU anchor is weak** (`LITMAN249493` names Nick + Morgan, not Litman). A stronger SQU anchor may exist if we relax the window or expand to internal NGM email, but as a third-party-to-client designation, this is the cleanest available. Consider pairing it with a post-7/21/2024 exhibit where Martha (not Goldberg) tells SQU "our attorney" about a Litman-era docket.
4. **UAEU anchor is plural** ("one of our attorneys"). There is likely a better UAEU anchor if we expand the search to also accept bodies saying "Richard Litman" literally rather than "our attorney" — worth running a V3 that hits on any explicit `Richard` + `Litman` token pair.
