Tasks: Discovery Gap #2 (NYSCEF docs for 524343/2025) + Gap #19 (federal docket for 1:25-cv-04048 EDNY).

Method: Live fetch via Playwright (Chromium) to bypass NYSCEF Cloudflare; CourtListener / RECAP for federal docket.

Result summary: - NYSCEF (524343/2025): All entries through #70 retrieved (live docket queried — no new filings between 2/25/2026 and 2026-04-28). Two missing PDFs (#68, #70) downloaded. Naming correction (load-bearing)

The pre-existing file NYSCEF_Doc_69_Plaintiff_BOP_Demand_2026-02-23.pdf was misnamed in a way that was easy to misread. The two BOP demands are mirror images filed the same day:

If counsel wants to confirm specifics, the docs of greatest relevance to the surviving NY § 51 case are: 1. Entry #37 — Federal Second Amended Complaint (11/24/2025). Listed as Exhibit D to Connell Foley's NY motion to dismiss (Doc #23 in NYSCEF). We may already have a copy through Litman's own production; if not, this is the most relevant federal pleading to retrieve from PACER. 2. Entry #40 — Notice of Voluntary Dismissal (1/12/2026). Defines whether dismissal was with or without prejudice; affects res judicata defense Goldberg has raised in NY (Sixth Affirmative Defense, see NYSCEF #69 demand items 12-14). 3. Entry #20, 24 — Sealing documents (9/30, 10/10/2025). Same exhibits Goldberg sought to seal in NY case (Combination Agreement, Award).

High-priority flags for Litman / counsel

  1. EDNY case is closed (voluntarily dismissed 1/12/2026). Goldberg's res judicata / collateral estoppel affirmative defenses (Sixth and Seventh in his Answer) cannot be founded on the federal case unless the dismissal was with prejudice. The NY court has already largely sided with Litman on res judicata (denying dismissal of Count V on 12/05/2025). Plaintiff's BOP demand (NYSCEF #69) items 12-17 specifically force Goldberg to particularize this defense — if he can't, the defense fails as a matter of law.

  2. Both 30-day BOP clocks expired ~3/25/2026. Doc #68 (defendant's demand to plaintiff) was filed 2/23/2026; Doc #69 (plaintiff's demand to defendant) same day. CPLR 3042(c) gives 30 days. As of 2026-04-28, both responses are overdue by ~5 weeks. The 4/2/2026 BOP deadline in the Preliminary Conference Order (Doc #70) has also passed without new NYSCEF filings to confirm compliance — this is a discoverable status to confirm with counsel (have BOPs been served outside NYSCEF? are motions to compel/preclude in the offing?).

  3. Doc #68 (Defendant's BOP demand) is narrowly drawn around §§ 50-51 and patents. It demands per-patent identification, per-use damages tied to that patent, and audience analysis. This is consistent with the case being narrowed to Count V — but the limited scope also means defense counsel is implicitly conceding the framework (patent face publication = compensable use). The demand items mirror the elements of the misappropriation claim, treating the patents as the operative publications.

  4. Doc #70 (Preliminary Conference Order) confirms Hon. Brian L. Gotlieb (J.S.C.). Form references Stephanie A. Rossini PC Order template (1-31-2022 / 10-24-2022 / 2-28-2024 revisions). Conference dates handwritten: 3/19/2026 (probable interim), 3/5/2026, 4/2/2026 (BOPs), 6/2/2026 (depositions). Matches CLAUDE.md case posture exactly.

  5. No NYSCEF docket activity since 2/25/2026. The case is in active discovery with both sides exchanging demands but nothing escalating to motion practice yet. Next NYSCEF event likely a motion to compel BOP response or a stipulated extension.

  6. No deposition transcript of 12/05/2025 oral decision found via NYSCEF. That transcript is still a CRITICAL outstanding item per COURT_FILINGS_MANIFEST.md. Court reporter, not NYSCEF. Outside scope here.


Tooling notes

NYSCEF is Cloudflare-protected; programmatic curl/WebFetch returns 403 with a "Just a moment…" managed-challenge page. Solution that works: Playwright headless=False with --disable-blink-features=AutomationControlled, navigate to the docket page first to clear the challenge, then fetch each PDF via in-page fetch() (not page navigation — Chromium's PDF viewer otherwise consumes the bytes). Script saved at /tmp/fetch_nyscef_pdfs3.py for reference; can be productionized into scripts/ if we're going to do this regularly.

CourtListener works with normal curl + Mozilla user-agent; the Atom feed at /docket/<id>/feed/ is the cleanest data source for an established docket.
